international-safety-management-code-ism-code ISM code has been the most controversial among all the chapters of SOLAS. There are plenty of seafarers and shore staff who feel that ISM code has only brought more paper work and nothing else. But a detailed report on the impact and effectiveness of the ISM code suggests that "where the ISM Code had been embraced as a positive step toward efficiency through a safety culture", tangible positive benefits were evident. But as you would note that the report has a caveat which is "Where the ISM code had been embraced as a positive step". How do we embrace ISM code as a positive step? The first step would be to know about the ISM code and its elements. In this post, we will discuss the 7 important elements of the ISM code. Let's get started. 1. Who is the Company as per ISM code The first thing we need to know is who is the company. As per ISM code Company means the owner of the ship or any other organization or person such as the manager, or the bareboat charterer, who has assumed the responsibility for operation of the ship from the shipowner and who, on assuming such responsibility, has agreed to take over all duties and responsibility imposed by the Code.     Non conformity is the term used in ISM code. PSC inspections follow the guidelines set by the MOU and IMO for PSC inspections (& not the ISM code). These guidelines require PSC inspectors to give deficiencies and these deficiencies are given different codes. In Safety management systems of most of the companies, PSC deficiencies are required to be considered a non conformity and need to dealt as non conformities. So even though all PSC inspections are non-conformities, both terms are different because these are required by different guidelines and legislations.

    Can a company have 2 or more DOC's??If a new type of ship joins a management company which is not mentioned on the existing DOC ,Then company will be issued a separate new DOC or the existing one will be amended ??

    Yes, Many companies have more than one DOCs. For example if a company is managing ships of 4 flags, Company need to have DOC from each of these flag, so in this case company will have 4 DOCs. Further if some of these ships have DNV class and others have ClassNK, then for each flag there will be two DOCs. One issued by DNV on behalf of that flag and other issued by ClassNK on behalf of that flag. So in total the company may have 8 DOCs. Further if company manages 3 type of ships, if they want they can have a different DOC for each type of ships or they can have all the ships mentioned in one DOC. Some companies do not prefer all the ships in one DOC as they feel that if for some reason DOC is revoked for a deficiency related to one type of ship, DOCs of all type of ship will become invalid and thus SMC of all the ships will become invalid and all the ships will not be able to sail till the time DOC become valid. Thos was the thinking during initial days of ISM code, now most of the companies prefer all type of ships in one DOC but choice is theirs. So that should answer your second query.

    In simple terms, an inspection (and surveys) is for equipments and audit is for procedures. ISM and ISPS code require the surveyor to check if procedures are in place. For example a safety equipment survey is more concerned about if the safety equipments are working or not. Whereas ISM audit is not concerned about if the equipments are working. it is more concerned about what procedures are followed if a safety equipment is not working. This actually is a good question and I will post a detailed answer sometime.

    Thanks for the detailed and well elaborated cotents , sir can you please explain the latest amendment which came on 2015 stating "periodically verify whether all those undertaking delegated ISM-related tasks are acting inconformity with the Company’s responsibilities under the Code". As I understand audits where already incorporated in ISM.

    It means that now it also becomes the company's responsibility that people are following ISM code and ship's SMS. Companies can no longer turn a blind eye to a violation of ISM code just because it might suit the company at that time (for example critical equipment not working because of lack of spares).

    Ref IACS Guidance No 41 ( Rev 2019) Annex 3 The Relationship between ISM Code & STCW 95 The largest portion of the STCW addresses the requirements for training, verification, and certification of seafarers. Responsibility for seafarer certification rests with the flag Administrations, and is not the responsibility of the Companies. This clearly eliminates the Company’s responsibility for many of the requirements of the STCW. The Company, however, carries responsibilities relevant to seafarer training. The Company’s responsibilities in this area fall into two categories: 1. those related to the certification of seafarers; and 2. training pertinent to the responsibilities imposed by the ISM Code.     Sir if a bunker checklist not sighted during external ism audit. Then auditor raised NC. Now how NC can be closed by chief engineer on ship

    Such NC can be closed by training of "filling up and use of bunker checklist" for all engine room staff. Training may be given by the master. Corrective actions need to be monitored after next bunkering and correctly filled next bunkering checklist along with training record will act as the supporting documents for close out of this NC.

    In many cases, the Flag Administrations may consider some codes, guidelines and/or standards as part of their regulations, which imply that those are to be considered as part of the ISM Reg 1.2.3.1 Refer to Flag State Marine Notices etc

    ISM Code Para 10.1 The Company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the Company. The relevant rules for surveys are included in SOLAS. The ship's SMS therefore must integrate the ship's Planned Maintenance System to satisfy survey requirements. Also the statutory survey certificates are issued on the condition that the ship will be maintained by the shipowner beween one survey to the next.

Wherever i ventured looking for and trying to understand ISM concepts, it made it murkier further but you have explained in short those important things very effectively. One clarification i would seek.. The term objective evidence is very frequently asked by the MMD surveyors and nothing seems to convince them. Is it correct to say that an objective evidence is more of a finding of an internal or external auditor during ISM audit which could amount to observation, Minor NC or a major NC?
